Terms & Conditions for buyers and sellers

Definitions


Who is Coogal?


Coogal is a trading name of Scott Trelfa. Scott Trelfa T/as Coogal will be referred to as ‘we’, ‘us’, ‘our’,   ‘the website’’ , ‘’the market place’’ in this document. 


Vendor


A vendor is an artist, creative or maker of any form of artwork, craft, design or product who has signed up to Coogal as a vendor with the intention of listing their own artwork or products for sale. 
Will be referred to as ‘you’, ‘Vendor’ or Seller’


Buyer


A Buyer is the end customer who has placed an order via Coogal’s website. 
Will be referred to as ‘’buyer’’ ‘’customer,  ‘’end customer’’, ‘’end user’’

Coogals responsibility


Coogal is acting as a broker to facilitate bringing together art buyers and art sellers. 


We will make all efforts to ensure that our website is functional at all times, there may be times during updates or unexpected server outages where it may be unavailable for reasons outside of our control.


We will not accept any responsibility for missed sales opportunities or your loss of profits if our website is down or not working for any reason. 

Sales are between the buyer and the vendor. 


We cannot accept any responsibility for items missing in the post or items not received, in the event that an item is not received we will act as a mediator between the buyer and vendor with an aim to resolve the issue. 

Types of art you may display in our online gallery


We invite artists, makers and creatives to join Coogal as a vendor, you are welcome to advertise your artwork for sale in our online art gallery shop www.coogal.co.uk


You may advertise and sell any form of art or craft. This could be painted, printed, 3D sculptures, any handmade or artisan item. This includes any form of art in any medium or technique this includes but is not limited to: original paintings, prints of your original paintings, 3D art such as sculptures, ceramics, pottery, handcrafted items such as jewellery, ornaments, kitchenware, home décor items, textiles & clothing. 

Product Categories
We have tried to list as many category options as we can, but as they display on our website with no products. To ensure the best experience for our end-users,  we have kept the list of options to a minimum to avoid having empty pages. 


If a category you need is not displayed, please contact us and we will happily add it for you. 

What we do not want on our website


We will not tolerate any hate, racism, sexism, homophobia or any other hate towards religious groups etc. on our website.


We ask that any artwork you are advertising for sale is tasteful and not offensive (we do appreciate humour and we will welcome any items which show satire) 


It is your own original work, and that you own all copyrights to it, we are NOT a market for dropship sellers. 


We will allow vendors to sell on-demand services and made to order items such as print on-demand items (such as printed T-shirts, books, mugs etc) as long as the designs being sold are your own work or designs. 


By listing items for sale on our website, you confirm that you have the item in your stock and is available in order to fulfil an order. 


You own the rights to display, market and sell the work and own the necessary copyrights, licences that are required to sell our work.  

You, as a vendor, are responsible for keeping your inventory up-to-date and ensuring that product descriptions and images are accurate. 

Membership & Vendor options


In exchange for the work that we carry out in operating and managing the website, marketing and promoting your work we will collect a commission from each sale &/or an upfront membership fee depending on what membership option you have chosen. 

We offer two vendor membership options:


Coogal Vendor
No fees, 10% commission per sale, allows you to list a maximum of 25 items in our gallery. 


Coogal Vendor+
£10 upfront fee, 5% commission on each sale allowing you to list an unlimited number of items. (the £10 fee is deducted from the payout disbursement from your first sale on Coogal’s online art gallery) 


We reserve the right to review fees and charges as and when required or for business operational needs, and will be reviewed annually and may be increased in-line with inflation and the like. 


Updated fees will be displayed here in our terms and conditions, and we will endeavour to contact vendors via email when changes are made and give you the option to opt out of being a vendor.


By signing up as a vendor you agree to share your name, address and email address with us. We do not hold any customer payment information. We will hold your information securely and treat it with the strictest confidence and follow data protection laws and GDPR.

Payments


In order to sell on Coogal you must have access to a PayPal account as this is where disbursement payments for items you have sold will be sent to. 


We will aim to make disbursement payments to you within 7 days of a customer order being placed via out website. 

Please note that a minimum disbursement of £25 applies, if your vendor balance is below this you will not receive a payment until your balance exceeds this. 

Buyers can pay using any form of payment, including credit/debit card, PayPal, ClearPay and Klarna. 

The sales process


When you receive a sale, the payment from the customer will be made to us using various payment gateways, these include various banking systems such as Klarna, Clearpay, paypal etc. 


A disbursement payment will be made to you via PayPal as soon as cleared funds are received from the payment option used by the buyer. 


The disbursement will be the sale price of the item minus our commission. 


If you have sold several items recently you may receive one combined payout. 

We will aim to make disbursement payments to the vendor within 7 days of a buyer placing an order, there could be delays due to bank holidays, vacations, sickness etc which may lead to this occasionally taking slightly longer to process. 


Once you receive an order you will receive an automated email from us to notify you that you have received an order. 


When a sale is completed, it is the vendors responsibility to make contact with the buyer and arrange collection or delivery of the artwork.  


We highly recommend that the vendor sends any sold items using a tracked and insured delivery service a communicates with the buyer in order to provide updates and tracking information and other information as required. 


It is the Vendors responsibility to ensure that you have relevant insurance in place for your items such as public liability. And that your items meet the relevant safety standards are tested and safe for their intended use. 

Listing items on our website gallery for sale


Listing items on our website marketplace can be done via your own online portal.
When you sign up you will receive your own username and password. 


We strongly recommend changing your password to your own as soon as possible. 


You can sign up as a vendor using the options on the menu of our website or by visiting the Sell on Coogal page. 
It is the Vendors responsibility to ensure that prices, size, and other details in their description are accurate. Coogal does not accept any responsibility for missing details or incorrect product images, or inaccurate product descriptions or Postage costs when listing items for sale

 

Please note that it is not currently possible for Vendors to set their own postage rates. 


Our website is restricted to only accept order from customers in the UK. 


In order to ensure that you receive an adequate disbursement payout for your sold work, please include postage in the advertised sale price. 


Fort example if you wish to sell an item for £100 and receive £10 for postage and packaging please advertise your item for sale at £110. 


When you set your advertised sale price, to ensure that you receive adequate funds for your sold item – please also remember to take into account the commission and any other costs you may incur such as PayPal transfer fees to receive funds. (some PayPal business accounts may charge a fee for incoming payments) 

Violation of terms and conditions

 

Reservation of our rights


We reserve the right to restrict, or limit selling rights or remove items listed for sale if we feel that the items or the vendors actions have violated our terms and conditions. This could include restricting the categories you can sell in or remove listed items or remove you as a vendor. 


Any violations will result in action being taken without warning, however you will have the write to appeal by contacting us and we will review our decision with the option of reinstating the vendors full access. 
 
We reserve the right to review and amend these terms as conditions as and when required. 

By joining us as a vendor we assume that you have read these conditions and that you agree to them.
